Our Real Estate Agency Represents the Seller:

The Agent assists the Buyer in showing him/her properties listed in the Multiple Listing Service (MLS), but our Agency does not have a signed agreement to represent the Buyer. Our Agency represents the Seller.

Our Real Estate Agency Represents the Buyer:

Our Agency represents the Buyer, and the Agent shows him/her properties listed in the MLS, as well as properties marketed as For Sale By Owner. The Buyer signs a Buyer Broker agreement with our Agency that states one of two conditions:

  • A: The Buyer works exclusively with our Real Estate Agency.
  • B: The Buyer retains the right to act on his/her own behalf

Fee For Service:

The Buyer clarifies what his/her needs are. The Agent assists the Buyer with specific areas of the real estate transaction for a specific fee. Below is an example of when Fee For Service is used:

A Buyer finds a house on his/her own time. At this point he/she needs help negotiating the deal, securing a signed Purchase and Sales Contract, and following through on one or more conditions.

Methods of Compensation:

Fee For Service is based on a specific fee. If our Real Estate Agency represents the Seller, the Seller pays the compensation due. If our Real Estate Agency represents the Buyer, options for compensation may include but are not limited to: a flat fee, a percentage of the sales price, a fee as determined by both parties and/or a retainer fee. Please note all compensation is a negotiated amount.

Consumer Information Disclosure:

VT Licensed real estate professionals are required to disclose agency status to prospective Buyers and Sellers. Wynne Associates can represent a Buyer or Seller through a written agency agreement.  Until Wynne Associates and a Buyer or Seller enter into a written agency agreement, that Buyer or Seller is a customer, not a client.  There is no confidentiality or fiduciary relationship until there is a signed agency agreement. Wynne Associates is a Non-Designated Agency. This means our agents cannot represent anyone whose interests conflict with yours when you are our client. For further information about your options, please contact Wynne Associates. Wynne Associates markets properties listed with other Agencies on behalf of Sellers through cooperation agreements and the Multiple Listing Service.
